This libel and trade disparagement action, filed on behalf of the client, Aveda, grew out of a claim by the defendant that Aveda was infringing its purported trademark. The defendant had picketed and distributed flyers to the public making disparaging statements about Aveda. One week into the jury trial, and despite its counterclaim against Aveda for trademark infringement, the defendant agreed to a permanent injunction enjoining it from picketing and making any statements about Aveda.
