When the clients, Kremers and Schwarz Pharma, sought to introduce a generic version of Prilosec® (omeprazole) into the consumer market, Astra mounted an extraordinary effort to prevent access to estimated sales of $10 million per day. The case against Kremers and Schwarz was placed into multi-district litigation with three other defendants. A team of fourteen attorneys represented the clients at trial, after which only Kremers and Schwarz were found not to infringe the patents, permitting them to introduce a generic version of Prilosec®.
